U.S. District Judge Richard Stearns on March 11 strongly affirmed his dismissal one year ago of medical malpractice and wrongful death claims against Dr. Briain MacNeill because plaintiff Sobeida Feliz repeatedly failed to serve him with court papers in his native Ireland. Sterns denied the plaintiff’s request for a fifth extension of the deadline to serve MacNeill.
Stearns also affirmed his June 2010 final judgment for MacNeill, based on the service issue, and “declined to act” on Feliz’s improperly filed motion to vacate, he wrote.
