The D.C. Circuit reversed a finding of the District Court that the appellant was properly convicted for receipt of illegal gratuities "for or because of an official act." The court found that the government failed to show that the appellant's alleged acceptance of money constituted a decision or action directly affecting any formal government decision made in fulfillment of the government's public responsibilities, as required by the applicable statute.
