After a dockworker was injured in an underground ore transport tunnel, the Benefits Review Board ordered the employer to pay the worker benefits under the Longshore and Harbor Workers' Compensation Act. Because the tunnel was not used in the vessel-unloading process, the injury did not occur on a LHWCA-covered situs. The case is remanded to the BRB for dismissal.
