This is an appeal from the trial court's judgment reversing a decision of the Board of Adjustment of the City of Dallas that upheld the revocation of a certificate of occupancy for an apartment complex owned by Billingsley Family Limited Partnership. Because the Board did not have certified copies of the pleadings in a prior proceeding with which to assess the res judicata argument, there was no basis for the trial court's award of costs against the Board. The award of costs is reversed, and the remainder of the trial court's judgment is affirmed. Dallas Court of Appeals, No. 05-12-00199-CV, 08-27-2013.
