Appellants challenge the sufficiency of the evidence supporting their federal jury trial convictions for alleged conspiracy to commit theft from a program receiving federal funds and their sentences. For the alleged crime of theft from a program receiving federal funds, the required nexus is not between the property and the federal funding, but between the criminal conduct and the organization, government, or agency receiving federal assistance. The district court's judgment is affirmed. 5th U.S. Circuit Court of Appeals, No. 12-10592, 07-16-2013.
