Employees of defendant-appellee Kellogg Brown & Root Inc. allegedly accepted kickbacks from two companies competing for subcontracts on KBR's prime contract to service American armed forces in military theaters across the globe. The trial court granted the KBR's motion to dismiss this Anti-Kickback-Act suit.The Anti-Kickback Act allows the government to allege vicarious liability.
