American Pharmacies challenged the Texas Health and Human Services Commission rulemaking obligations and certain rules promulgated by HHSC related to pharmacy benefits under Texas's Medicaid managed care program. Construing the governing statutes and rules in their entirety and in the context of the goals and policies they are intended to promote, as well as in light of the legislative history and prior provisions, the plain language of the relevant statutes does not impose on HHSC the duty to set rates for pharmacy reimbursements in the MMC context. The court's judgment granting the plea to the jurisdiction is affirmed.
