The appellants challenge the district court's dismissal of their claims against a bank in this dispute over an attempted foreclosure. Considering a nonwaiver clause in the deed of trust, the bank did not waive its rights. At most, the evidence demonstrates that the bank delayed foreclosure while attempting to reach an alternative agreement to protect its interests.
