The defendant appeals the denial of summary judgment in this false arrest and excessive force case. The plaintiff was tasered twice, once while lying face-down on the ground in handcuffs. The use of force was clearly excessive to the need and objectively unreasonable. The denial is reversed in part, and the case is dismissed in part. 5th U.S. Circuit Court of Appeals, No. 11-41109, 05-15-2013.
