The Equal Employment Opportunity Commission appeals a district court judgment finding that firing someone because of lactation or breast-pumping is not sex discrimination, and that lactation is not a related medical condition of pregnancy. Discharging a female employee because she is lactating or expressing breast milk constitutes sex discrimination in violation of Title VII. The district court's judgment is vacated and remanded. 5th U.S. Circuit Court of Appeals, No. 12-20220, 05-30-2013.
