The appellants challenge a judgment against them on claims relating to an allegedly defective humidor. Because an engineer's affidavit provided by the appellees does not identify or otherwise discuss any knowingly false or recklessly-made representations by the appellant upon which the appellant intended appellees to rely to their detriment, the trial court abused its discretion by denying the appellant's motion to dismiss with respect to appellees' fraud claim. The trial court's order is affirmed in part, reversed in part and remanded. Beaumont Court of Appeals, No. 09-12-00325-CV, 03-28-2013.
