The trial court affirmed an administrative law judge's order granting the Texas Department of Public Safety's petition to suspend the appellant's driver's license. In support of the underlying stop, the only relevant evidence in the record is that the appellant was observed driving slowly on the Sam Houston Tollway at 1:40 in the morning; this is not substantial evidence to support the ALJ's finding of reasonable suspicion to stop. The judgment of the county civil court is reversed and judgment is rendered reversing the ALJ's order and denying the DPS petition to suspend.
