A case involving a workplace injury caused by a trench collapse gave the N.J. Supreme Court the opportunity to address the legal test surrounding the "intentional injury" exception to the N.J. workers' compensation bar. The result confirms that plaintiffs must meet a very high burden of proof indeed.
