One person who asks another for help in a potentially violent situation owes a duty of care to him and can be liable if he is injured or killed, an appeals court ruled on Monday.
In Estate of Novaly v. Vertus, A-2132-09, the Appellate Division reversed the dismissal of a suit against the owner of a business where the decedent was fatally shot while investigating what turned out to be a robbery in progress.
