Baker Botts Beats Back Alien Tort Suits Against Drummond, Again

Two years ago, Baker Botts partner William Jeffress won a defense verdict for coal mining company Drummond in what was believed to be the first Alien Tort Claims Act case to go to trial. Despite the verdict -- which was later upheld by the 11th U.S. Circuit Court of Appeals -- Drummond is still facing litigation over the 2001 murder of three union leaders at a Colombian mine. But the plaintiffs suing Drummond haven't gotten very far.

Felon Involved in Clandestine Videos of Ecuador Judge in Chevron Case

One of two men who made clandestine video recordings allegedly showing government bias and kickback-soliciting in a $27 billion oil contamination lawsuit against Chevron in Ecuador is a convicted felon with a history of legal troubles, according to The Associated Press. Wayne Douglas Hansen and an Ecuadorean man who has done technical contract work for Chevron videotaped a judge who is heard to say "yes" at one point when asked repeatedly whether he planned to rule against Chevron.

Panel Finds Non-Signatory Bound by Predecessor's Forum Agreement

A non-signatory to an agreement may be bound by a forum selection clause in contracts entered into by a predecessor in interest, the 2nd U.S. Circuit Court of Appeals ruled Friday. Reviving a federal lawsuit in New York over defaulted loans in connection with a water and sewer concession in Argentina, the circuit said "the fact that a party is a non-signatory to an agreement is insufficient, standing alone, to preclude enforcement of a forum selection clause."

Faced with the prospect of harsh discipline from the 9th U.S. Circuit Court of Appeals, well-known plaintiffs lawyer Walter Lack attempted the following play on Thursday: Convince three judges that his misconduct wasn't intentional, even though he signed a document admitting it was. Rather than helping his cause, the panel appeared to think Lack was dodging responsibility. Lack may have actually aggravated his situation by appearing in person, said one judge.
