Freed Equatorial Guinea Coup-Plotter Says U.S. and Others Should Face Justice

British mercenary Simon Mann has threatened to settle some old scores after arriving home Wednesday following more than five years in African jails for a failed plot to take over Equatorial Guinea's oil riches. Some governments may be worried about a vengeful Mann: He testified last year that the U.S. and European governments knew of the 2004 plot in advance and welcomed it, as did international oil companies operating in the small West African nation.

With corporate America itching for the Supreme Court to rein in use of the Alien Torts Statute for suits alleging overseas wrongdoing, the case that may redefine the parameters of the ATS is shaping up as a battle of ex-Harvard law professors. On Monday the Court asked U.S. Solicitor General Elena Kagan to weigh in on Pfizer Inc. v. Rabi Abdullahi, in which the 2nd Circuit revived the claims of Nigerians who allege they were grievously harmed by a Pfizer drug in a government-approved clinical trial.

A New York court will preside over a $15 million employment dispute between a Greek citizen and a Liberian company publicly traded in the United States, which allegedly raised funds in New York and retained a Manhattan-based law firm as its primary outside counsel, a state judge has ruled. Excel Maritime Carriers Ltd., which is based in Athens and incorporated in Liberia, had claimed it would be unduly inconvenienced if the breach of contract and libel case remained in New York.

Federal prosecutors unsealed an indictment against a Washington, D.C., lobbyist Tuesday for allegedly violating sanctions against the government of Sudan. According to the Justice Department, Robert Cabelly, a former State Department official and managing director of C/R International, did work for the Sudanese without permission from the U.S. government. The firm allegedly brokered business contracts for the country, and gave it "sensitive" U.S. government information.

A federal appeals court has set a high bar for foreign plaintiffs attempting to use U.S. courts to hold foreign defendants accountable for human rights violations in foreign lands, ruling that liability can be imposed only where it is shown that a defendant "purposefully" aided and abetted a violation of international law. In a major decision Friday, the 2nd Circuit clarified the standard for aiding-and-abetting and conspiracy liability under the Alien Tort Statute.
