A federal judge in Michigan last week dismissed a claim for wrongful termination brought by a Wal-Mart employee who was fired for testing positive for marijuana.
Joseph Casias was legally registered to use the drug to treat the side effects of an inoperable brain tumor. The 2008 Associate of the Year at the Battle Creek, Mich., Wal-Mart claimed he only used the drug after his work shift and never came to work high. Last November, Casias twisted his knee on the job, and company policy dictated that he take a drug test.
