SAN FRANCISCO — An Oakland lawyer’s six-year odyssey to hold the federal government liable for warrantless wiretapping appears to have many more years yet to go.

On Friday the U.S. Court of Appeals for the Ninth Circuit sounded poised to throw out federal Judge Vaughn Walker’s 2010 ruling in al-Haramain Islamic Foundation v. Obama on the basis of sovereign immunity. But the judges hinted they might remand the case to allow Jon Eisenberg and his co-counsel to pursue FBI director Robert Mueller in his personal capacity.
