SAN FRANCISCO — The California Supreme Court granted a death row inmate a new penalty phase trial on Monday, ruling that a trial court judge shouldn’t have excused a juror just because she hadn’t fully formed an opinion on the death penalty.
It’s the second time in about a month that the court has thrown out a death judgment — both over dismissals of jurors. The last reversal ended a two-year streak of 45 death judgments the court upheld.
