In 2010, the Proposition 8 ban on same-sex marriage was put on trial. On Thursday, the judge who presided over the case was put on the hot seat.

In back-to-back oral arguments at the Ninth Circuit U.S. Court of Appeals on Thursday, Prop 8 proponents attacked retired Judge Vaughn Walker for creating a video of the trial and then publicly airing snippets. Then they argued that all of Walker’s rulings in the case should be deleted — including his ultimate holding — on the grounds that, because he was in an undisclosed, long-term same-sex relationship, he couldn’t be impartial.
