The Ninth Circuit U.S. Court of Appeals today called out the government for keeping an important file from an immigrant facing deportation and ordered further proceedings after pointing out unexplainable discrepancies in key records unearthed on appeal.

A three-judge panel overturned an immigration court’s order of removal, finding that a Honduras-born man’s rights were violated when the government failed to turn over his “A-file” — a file kept on aliens that typically contain official records such as naturalization certificates and petitions for benefits under the immigration and nationality laws.
