SAN FRANCISCO — Attorneys battling over the pending execution of a condemned killer are under a six-hour deadline today to get new briefs to San Jose U.S. District Judge Jeremy Fogel.

Fogel, who effectively paused executions in the state in 2006, is now back in the position of deciding the immediate fate of rapist and murderer Albert Greenwood Brown, following a Monday night ruling by the Ninth Circuit U.S. Court of Appeals.
