A Florida appellate panel has affirmed the dismissal of a false-light invasion of privacy suit brought by a developer against a homeowners' association member. The judges ruled that the association member's criticisms of the homeowner's board, of which the developer is a member, could not be construed as a direct attack on the developer. Early next year, the Florida Supreme Court will be considering the concept of false light as an actionable claim, and media attorneys are paying attention.
