U.S. District Judge Charles Breyer raised concerns Friday that Wilson Sonsini Goodrich & Rosati may have a conflict of interest in litigation over options backdating at Brocade Communications Systems Inc. Two retirement funds are fighting a proposed settlement of derivative litigation, saying Wilson lawyers are putting the firm's interests ahead of Brocade's. Wilson has long represented Brocade in corporate matters, and is now simultaneously representing the company and its current and former officers.
