The family of a teenager who committed suicide in 2002 after taking the antidepressant drug Paxil is not barred from suing SmithKline because the FDA had not yet taken a position on any link between pediatric patients' use of such drugs and an increased risk of suicidality, a federal judge has ruled. The judge rejected SmithKline's argument that the suit was barred based on a 3rd Circuit decision blocking suits against the makers of Paxil and Zoloft over the lack of warnings for adult users.
