By setting constitutional limits on a judge's discretion to sentence, the Supreme Court's decisions in Apprendi v. New Jersey and Blakely v. Washington called into serious question the sentencing schemes of the federal government and dozens of states -- and generated a mountain of litigation. At their private conference this week, the justices will consider whether to hear a case that presents yet another wrinkle in the ever-evolving field of sentencing jurisprudence.
