The Georgia Supreme Court has ruled that the state's participation in a $246 billion tobacco settlement with 46 states bars a lung cancer victim's heirs from seeking punitive damages from Brown & Williamson Tobacco Corp. Plaintiffs counsel Leslie J. Bryan said the decision is the first by a state high court that the 1998 multistate settlement precludes an individual's claim for punitive damages.
