Merck & Co.'s voluntary recall of Vioxx was based on new data showing the increased risk of heart attacks or strokes, but one Texas woman's suit alleges that prior studies showed "serious adverse risks" from taking the popular arthritis and pain medication. Her case will test Texas' H.B. 4 -- a tort-reform measure that provides new presumptions of non-liability for drug defendants in products liability suits and establishes new venue concerns that could impact Vioxx suits.
