In a case of first impression, a New York appellate court has approved a lesbian couple's adoption of a 5-year-old girl. Despite the absence of specific legislative authority for adoption by two unmarried adults, the Appellate Division, 4th Department reversed a family court dismissal of the petition. The appellate court based its 3-2 ruling on a Court of Appeals decision that approved the adoption of the biological child of one parent by an unmarried partner.
