In a recent trademark case, In-N-Out is alleging that Smashburger’s “Triple Double” burger is infringing on their own “Triple” burger. In-N-Out does not, in fact, own a “Triple Double” trademark and is, rather, stating that the names are similar enough that customers will get confused. It’s begs the question—how can In-N-Out prove people are confused?
