A Manhattan judge has dismissed a lawsuit by a group of terminally ill patients seeking to block prosecution of physicians who assist mentally competent terminally ill patients to die.

The plaintiffs in Myers v. Schneiderman, 151162/2015, which also include five medical professionals and the advocacy group End of Life Choices New York, sought a declaration that physicians who provide “aid-in-dying” service to terminally ill patients are not criminally liable under existing state statutes and an injunction to prohibit prosecution.
