91 Companies Facing FCPA Investigations
Just how many companies are caught up in ongoing Foreign Corrupt Practice Act (FCPA) antibribery investigations by U.S. law enforcement these days? That would be 91 (that we know of), according to the latest quarterly update from The FCPA Blog.
In the meantime, companies that have appeared in previous FCPA reports, such as Total SA and Parker Drilling Company, have resolved FCPA investigations, while companies including Disney and Wal-Mart have yet to budge from the list.
“The reluctance of corporate defendants to fight FCPA charges has created limited opportunity for courts to issue guidance regarding the reach of the FCPA, the result being that the government's position has become the prevailing view,” Gruenstein writes. “Questions as to the scope of the FCPA, however, have recently begun to receive attention from courts in government prosecutions against individuals, and will continue to be the subject of judicial scrutiny in the future.”
