Back in June 2011, the National Labor Relations Board (NLRB) approved a set of rules that would accelerate the union election process, allowing employers less time to prepare and to try and convince employees of the downsides of forming a union. The rules were thrown out when the U.S. district court in Washington, D.C., determined that the NLRB did not have the proper quorum to make valid decisions at the time the rules were approved.

However, now that the NLRB has a full set of members, the so-called ambush or quickie election rule is back. The board announced on Feb. 5 that it is proposing a new list of rules [PDF], which it characterized as identical in substance to the failed 2011 proposals.
